Terms & Conditions
These terms govern use of kalharenterprise.in and enquiries, quotations and orders placed with Kalhar Enterprises.
Last updated: 8 September 2026Important: This website is primarily a B2B product-information and quotation website. Displaying a product does not constitute an offer at a fixed price. A transaction is governed by the accepted written quotation, order confirmation, invoice and any specifically agreed terms.
1. Business Details
The website is operated by Kalhar Enterprises, a proprietorship trading under the Kalhar Enterprise name.
2. Acceptance of These Terms
By accessing this website, submitting an enquiry, requesting a quotation or placing an order, you confirm that you have read and agree to these terms to the extent applicable to your interaction.
If you act for a company or other organization, you confirm that you are authorized to submit the enquiry or place the order on its behalf. If you do not agree with these terms, do not use the website or submit information through it.
3. Website Purpose and Availability
The website provides general information about spill kits, windsocks, windsock stands, fire blankets, security jackets and related safety products. It also allows buyers to request private quotations.
We may update, suspend or remove website content or functions without notice. We do not guarantee uninterrupted, error-free or continuously available access, although we take reasonable steps to maintain the website.
4. Quotations
- A website enquiry is a request for information and does not create a binding order.
- Prices are normally provided privately in a written quotation and are not displayed publicly.
- A quotation is valid for 7 days from its date unless a different period is stated in that quotation.
- A quotation is based on the specifications, quantity, delivery destination and information provided by the buyer.
- Changes to quantity, material, size, printing, packaging, delivery location or other requirements may require a revised quotation.
- Typographical, calculation or clerical errors may be corrected before order acceptance.
5. Order Formation and Acceptance
An order becomes binding only when Kalhar Enterprises expressly accepts it in writing and receives the required advance payment, unless the written quotation states otherwise. A buyer purchase order alone does not require us to supply goods until we accept it.
The accepted quotation, approved specifications or artwork, our order confirmation, invoice and these terms together form the agreement. If there is a conflict, specifically negotiated written terms in the accepted quotation or order confirmation take priority.
Do not begin site planning or installation solely from catalogue images. Final dimensions, supplied components and project-specific requirements must be confirmed in writing.
6. Product Information and Images
We aim to keep descriptions, specifications and images accurate. However:
- catalogue and website images may be representative and may not show the exact supplied product;
- colours can appear different because of lighting, photography and display settings;
- stated weights and dimensions described as approximate may vary within normal production or packing tolerances;
- custom products are manufactured according to the final written and approved specification; and
- product specifications may be improved or changed, provided material changes are confirmed before an accepted order is processed.
No standard, certification, test result or regulatory compliance should be assumed unless expressly stated in the accepted quotation and supported by the relevant available documentation. Pending certifications are not represented as completed certifications.
7. Buyer Responsibilities
The buyer is responsible for providing complete and accurate requirements, including:
- the correct product type, variant, capacity, size and quantity;
- delivery address, PIN code, contact details and access restrictions;
- chemical or acid identity, concentration, expected spill volume and Safety Data Sheet where relevant;
- site conditions, installation requirements and compatibility information;
- approved artwork, spelling, colours and print placement for customized products; and
- any mandatory tender, industry or end-user specification before ordering.
Recommendations are based on information supplied by the buyer. The buyer must independently confirm suitability for its intended application, workplace risk assessment, installation and legal or industry requirements.
8. Prices, GST and Freight
Unless expressly stated otherwise in writing:
- quoted prices are exclusive of GST;
- GST is charged at the applicable rate shown in the quotation or invoice;
- freight, insurance, unloading, installation, duties and destination charges are extra;
- freight is calculated according to destination, quantity, weight, dimensions and carrier availability; and
- prices may change after quotation expiry or if requirements change.
9. Payment Terms
Orders placed through website-generated enquiries require 100% advance payment, unless a written quotation expressly provides different terms. Processing, procurement, printing or manufacturing may begin only after cleared funds and all required approvals are received.
The buyer is responsible for using the payment details stated on an authentic quotation or invoice. Please verify unexpected bank-detail changes directly with us by calling +91 91732 00211 before paying.
10. Minimum Order Quantities
| Product | Current Standard MOQ |
|---|---|
| Spill kits | 1 kit |
| Windsocks | 1 piece |
| Windsock stands | 1 piece |
| Fire blankets | 1 piece |
| Standard security jackets | 15 pieces |
| Customized security jackets | 100 pieces |
Custom construction, special materials, printing or non-standard packaging may require a different MOQ, which will be stated in the quotation.
11. Dispatch and Delivery Estimates
Dispatch time depends on product availability, order quantity, customization, approval status and destination. Any dispatch or delivery date is an estimate unless expressly guaranteed in writing.
Delivery can be affected by carrier delays, weather, transport restrictions, public holidays, strikes, government action, supply interruption or other circumstances outside reasonable control. Further information is available in our Shipping & Returns Policy.
12. Inspection, Shortage and Manufacturing Defects
The buyer should inspect the shipment promptly upon receipt and preserve the packaging, invoice, delivery record and supporting photographs if an issue is identified.
Claims relating to visible transit damage, shortage, incorrect supply or an alleged manufacturing defect must be reported promptly and within any reporting period stated in the quotation, invoice or delivery documentation. Products must not be installed, altered, printed, used or returned without authorization where doing so may prevent fair inspection.
13. Warranty and Returns
Warranty is not applicable unless a specific written quotation expressly states otherwise. Returns are accepted only for a confirmed manufacturing defect or other remedy required by applicable law.
Customized products, special sizes and printed products are non-returnable after specifications or artwork have been approved, except where a manufacturing defect or an error attributable to Kalhar Enterprises is confirmed. Change-of-mind returns are not accepted. See the Shipping & Returns Policy for the claim process.
14. Limitation of Liability
To the maximum extent permitted by law, Kalhar Enterprises will not be liable for indirect, incidental, special or consequential loss, loss of profit, business interruption or loss resulting from incorrect buyer specifications, unsuitable selection, improper storage, unauthorized modification, installation error or use contrary to instructions.
Where liability cannot lawfully be excluded, our liability will be limited only to the extent permitted by applicable law and, for a specific order, will not exceed the amount paid for the affected goods unless the law requires otherwise. Nothing in these terms excludes liability or rights that cannot legally be excluded.
15. Intellectual Property
The Kalhar Enterprise name, logo, Safe Cure branding, website design, product copy, graphics and other original website material are owned by or licensed to Kalhar Enterprises. You may view and print website content for legitimate purchasing or internal evaluation. You may not reproduce, republish, remove branding, misrepresent ownership or use the content commercially without prior written permission.
16. Events Beyond Reasonable Control
We are not responsible for delay or failure caused by events beyond reasonable control, including natural disaster, fire, flood, epidemic, war, civil disturbance, government restriction, transport disruption, labour action, power or internet failure, supplier interruption or raw-material shortage. We will take reasonable steps to communicate and reduce the effect where practicable.
17. Governing Law and Jurisdiction
These terms and related transactions are governed by the laws of India. Subject to any mandatory statutory forum or remedy, courts having jurisdiction in Ahmedabad, Gujarat will have jurisdiction over disputes. The parties should first attempt to resolve a dispute through good-faith written communication.
18. Changes to These Terms
We may update these terms when our business, website or legal requirements change. The revised version applies from the “Last updated” date shown on this page. Terms governing an already accepted order remain those incorporated into that order unless both parties agree otherwise in writing.
